侵權投訴一直是亞馬遜平臺的一個高發(fā)問題。

賣家們確實也挺頭疼的。

可以明顯發(fā)現(xiàn)的是，亞馬遜對侵權已經(jīng)越來越嚴格，近期就受理了很多新的侵權投訴。

來看一個賣家案例。

這是我們近期收到的一個賣家郵件。

郵件內(nèi)容如下：

Hello,

We removed some of your listings because we received a report from the rights owner below that these products may violate the anti-circumvention provision of the Digital Millennium Copyright Act, 17 U.S.C. § 1201. Specifically, the rights owner alleges that the products that have been removed decrypt and display HDCP content but are not licensed by the HDCP licensor, Digital Content Protection LLC. The listings we removed are at the bottom of this message.

If you have never sold or listed the product, please reach out to us and tell us.

If you think that the rights owner has made an error in sending the notice, please reach out to the rights owner and ask for a retraction of the notice. To retract the complaint, the rights owner must send the retraction to us at notice-retraction@amazon.com or use the retraction function in Brand Registry. We can only accept retractions if the rights owner clearly states that they made an error.

根據(jù)郵件反應，這個賣家侵權了。

版權侵權其實在亞馬遜上很常見，我們之前也幫助很多客戶解決過各種各樣的版權侵權問題，但是這一次的侵權主體，我們確是第一次碰到。

根據(jù)郵件顯示：侵權的版權是HDCP技術

HDCP技術，中文名稱是 高帶寬數(shù)字內(nèi)容保護技術，是好萊塢跟英特爾公司合作開發(fā)的一項數(shù)字視頻保護技術，能對視頻的輸出進行質(zhì)量保護及防盜保護。

總結(jié)就是一項，比較牛X的高新技術。

這項技術的權利人還是赫赫有名的好萊塢跟英特爾，那侵權這項技術的賣家是不是鏈接就沒救了？

事實上，并非如此。

HDCP是一個基于數(shù)據(jù)加密和授權驗證的內(nèi)容保護系統(tǒng)。

郵件顯示，賣家侵權的主要原因是因為客戶使用了這項HDCP，但卻未經(jīng)授權。

也就是說只要取得技術所有人的授權就可以恢復鏈接，繼續(xù)售賣自己的產(chǎn)品了。

目前，這項HDCP技術已經(jīng)處于一個廣泛授權的狀態(tài)，只要應有者需要的產(chǎn)品都可以聯(lián)系品牌方進行授權，獲得HDCP技術支持的設備擁有一個獨一無二的HDCP密鑰（Secret Device Keys）。

并且能在授權許可名單上進行查詢，蘋果就是這項技術的其中一個客戶。

下面是部分HDCP的授權示例產(chǎn)品

通過這個案例我們總結(jié)如下

一、HDCP技術主要應用于音頻，視頻類的電子產(chǎn)品，有做相關產(chǎn)品的賣家也要看下自己的產(chǎn)品是否在未經(jīng)授權的情況下使用了相關技術，之后有被訴風險。

二、亞馬遜現(xiàn)在對于侵權投訴的受理已經(jīng)不僅僅局限于，商標，圖片或者產(chǎn)品外觀了，現(xiàn)在還出現(xiàn)了高新技術的版權受理，可以說侵權的受理范圍已經(jīng)逐漸擴大，可以預見未來還將出現(xiàn)更多的侵權情形。

三、遇到任何類型的侵權投訴，都不要著急放棄產(chǎn)品，積極處理才能最大限度挽回損失。像以上案例的客戶就可以自行聯(lián)系品牌方進行技術授權，或者委托美國律師聯(lián)系授權（更高效），進而恢復產(chǎn)品的售賣。
